No prenuptial agreement for Jennifer Aniston and Justin Theroux

Thirteen years after first walking down the wedding aisle, Hollywood actress Jennifer Aniston is planning to make that walk again. The 44-year-old actress is engaged to 41-year-old actor Justin Theroux and the two are reportedly planning to wed within the next few months. While friends of the former Friends star are thrilled she's found love again, many report being concerned by Aniston's recent decision not to sign a prenuptial agreement.

A prenuptial agreement is a legal document which serves to protect the assets an individual brings to a marriage. Preups are commonly used by wealthy individuals to ensure an ex-spouse cannot walk away with millions in the event a divorce occurs. In cases where wealthy and famous individuals have failed to have a prenup, divorces often drag on for months or years and cost the wealthier spouse millions of dollars.

While hopefully no one enters into a marriage with the idea it is a temporary arrangement, the fact is that marriages fail. It's especially interesting that Aniston, who has already been divorced once, has chosen to forego a prenuptial agreement. Friends of the actress fear her decision may end up costing her dearly. In fact, some estimate Theroux could walk away with up to $150 million should the couple divorce.

Prenuptial agreements aren't just for millionaires. With more people delaying marriage, many individuals bring a considerable amount of assets to a marriage. It's wise, therefore, to protect these assets and be realistic about the fact that a marriage may in fact not last til death parts a couple.

Individuals who want to protect their assets and avoid a lengthy and contentious divorce settlement process would be wise to consult with a family law attorney. An attorney who handles matters related to divorce can help ensure for the best possible outcome in the event a divorce occurs.
